1. Important Information

Read the following terms and conditions before making a purchase of any template or other product or service on freeoscommerce.com.  It is your responsibility to fully understand these terms before purchase.  Purchasing, using and/or downloading any product or service from the freeoscommerce.com  or any affiliated website implies that you have read and fully understand these terms and conditions.

2. Refund Policy

Website templates are non-tangible irrevocable goods.  We therefore do not offer any exchanges or refunds.  Only in rare cases where the template downloaded is deemed not as described will any such accomodation be considered -- such cases will be assessed and handled at our sole discretion and judgement.  Any request  for refund consideration must be made within five (5) days of the template purchase date

3. Licensing Information

3a. Single-use License

With each template purchase you are granted a single-use (one time only) license to use the template one time on your or a client's system/website.  In order to use the template with another project or website you must re-purchase the template and obtain an additional license.

3b. Unauthorized Use and/or Distribution

You may not place any freeoscommerce.com templates or other products, modified or unmodified, on a storage device, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from freeoscommerce.com support.

3c. Assignability

You may not assign, sub-license, or transfer this license to anyone without prior written consent from freeoscommerce.com.

3d. Ownership

You may not claim ownership of any freeoscommerce.com template or product.

4. Warranties and Guarantees

All freeoscommerce.com templates are provided 'as-is' with no guarantees or warranties of any kind (explicit or implied).  In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use freeoscommerce.com templates and/or any other products or services offered through this or an affiliate website.

5. Modifications

You are authorized to make necessary modification(s) to our templates to fit your purposes in accordance with this license.

6. System Compatibility

It is your responsibility to ensure that you are purchasing/downloading the correct template for the appropriate version of osCommerce and/or CMS Made Simple.  downloading the wrong template or finding that  a template does not work with your system does not qualify you for a refund.  The templates and/or other code on freeoscommerce.com have not been tested on all systems.  There may be systems and/or system configurations that the templates will not work properly on.  It is your responsibility to utilize the available free templates and other information to decide whether or not to purchase a premium template.

7. Indemnity

By purchasing, downloading and/or using a template or any other service from this website you agree to defend, indemnify and hold harmless Freeoscommerce.com, including all employees and associates, from and against all claims, actions or demands, liabilities settlements, including without limitation, reasonable legal accounting fees, alleged to result from your use of the site and/or products, Freeoscommerce.com services or your violation of this Agreement.

8. Terms and Conditions Update Policy

Freeoscommerce.com reserves the right to change or modify these Terms and Conditions with no notice.

It is your sole responsibility to understand these terms and conditions before making a purchase or download and/or using a freeoscommerce template or other product.  If there are any questions or a need for clarification, please contact freeoscommerce.com before purchasing a template.
